Ensure you read these terms and conditions carefully, by using the named site and associated sites you are agreeing to be bound by the following terms and conditions.

The Terms and Conditions govern your use of, and any purchase from ‘the site’. Any such purchasing from the ‘the site’ establishes an agreement between you and Evotech Pacific Pty Ltd.

1. Product or Service Availability, Errors, Inaccuracies and Pricing

If there is a product or service to which you are interested in that is unavailable then please contact Evotech Pacific Pty Ltd and we will be able to invoice you for such product on backorder or notify you when such product or service is back in stock or available. ALL PRICES DISPLAYED IN OUR ONLINE STORE ARE IN AUSTRALIAN DOLLARS (AUD) INCLUDINGING GST. ALL PRICES DISPLAYED ON GENERAL PAGES FOR SPECIAL ORDERED ITEMS ARE DISPLAYED IN USD EXCLUDING GST AND LOCAL SHIPPING FROM BRISBANE.

Although all due care is taken, the information on the site can have discrepancies or be inaccurate and this may relate to product or service descriptions, pricing, advertisings, offerings and promotions, product shipping charges, goods in transit times and availability. Evotech Pacific Pty Ltd takes all due care to avoid such errors however they still may occur. In the event of an error Evotech Pacific Pty Ltd reserves the right to correct any and all errors when they do occur and do not honour inaccurate prices or information.

In the event that a products price or stock count is lower than the actual price or stock count, Evotech Pacific Pty Ltd at their discretion will firstly contact you for instructions before shipping the item, we also reserve the right to cancel the order and you will be notified of such cancellation. Customers who order an item at an incorrect price may cancel their order. In the event that the order has been shipped, you agree to either return the product or pay the difference in price discrepancy.

Prices of Evotech Pacific Pty Ltd products and services are subject to change without notice. Evotech Pacific reserve the right to change incorrect prices and are not obliged to provide any products or services at an incorrect price. Evotech Pacific reserve the right at any time to modify or remove a service without notice. Evotech Pacific are not liable to you or any third-party for alterations, price changes or discontinuances of a service.

2. Returns Policy

The returns policy applies to all goods available for purchase at Evotech Pacific Pty Ltd, note further terms and conditions apply to special orders, custom-made items and services.

In the case that you wish to return an item for repair, replacement or refund it must meet the requirements of the Nowlan Jewellery Co returns policy which can be read here.

If your item has been approved for return subject to inspection, the item must include a proof of purchase and the return confirmation email.

3. Australian Consumer Law & Governing Laws

All goods and services on offer by Evotech Pacific Pty Ltd fall under the rights of Australian Consumer Law. As a consumer you have the right to ask for a repair, replacement or refund if the item has a major problem.

If the item you have purchased meets the criteria of a major problem as defined by Australian Competition and Consumer Commission (ACCC) you are entitled to return the item for a refund or exchange, it is important to understand that the remedy to the problem will be subject to the problem itself.
